ARTICLE 1 - GENERAL PROVISION
SECTION 1
PREAMBLE
We the entire members of Christ The King Catholic College Old Boys Association (CKCCOBA) willingly, voluntarily and in full realization of the necessity consolidate ourselves into an active, progressive and democratic association do hereby resolve to be united in mind and purpose to pursue the following fundamental objectives:
- To engage our members to the quest of peace, unity and progress.
- To uphold our fundamental human rights as enshrined in the constitution of the Federal Republic Of Nigeria.
- To devote our energy to fostering unity among our members.
- To harness our resources towards development goals.
- In pursuance of the facts highlighted above, we hereby ordain and establish this statute hereinafter referred to as the constitution of Christ The King Catholic College Old Boys Association (CKCCOBA).
SECTION 2
DEFINITIONS
- “CKCCOBA” refers to Christ The King Catholic College Old Boys Association
- “Constitution” refers to the constitution of Christ The King Catholic College Old Boys Association (CKCCOBA)
- “Members” refers to anyone who attended Christ The King Catholic College Odolewu Ijebu.
- Association refers to Christ The King Catholic College Old Boys Association (CKCCOBA) .
- “Committee” refers to any committee set up based on this constitution or through a resolution of the association.
SECTION 3
SUPREMACY OF THE CONSTITUTION
- This constitution is supreme and its provision shall have binding force on the members of Christ The King Catholic College Old Boys Association (CKCCOBA).
- The constitution shall be in accordance with states laws and the constitution
- Any provision of this constitution which is inconsistent with any states laws or constitution of the Federal Republic of Nigeria shall be null and void to the extent of its inconsistency.
SECTION 4
NAME AND ADDRESS
- This constitution establishes a group called “Christ The King Catholic College Old Boys Association (CKCCOBA). The location shall be within the confines of Odolewu Ijebu, Ogun State, Nigeria except otherwise directed by the executive.
SECTION 5
AIMS AND OBJECTIVES
- To develop common ties among members irrespective of their religious or ethnic backgrounds for the sake of national unity and development
- To harness our resources together in achieving a developmental project for our alma mater
- To help encourage the spirit of hardwork and dedication among members.
- To promote amiable co-existence between members of the association
- To ensure that the welfare of all members are well attended to.
- To serve the association in loyalty and honesty.
ARTICLE 2 - MEMBERSHIP
SECTION 1
COMPOSITION
- Anyone who has attended Christ The King Catholic College Odolewu Ijebu qualifies as an automatic member if he desires to join the association.
- Subject to the above provision membership shall be confirmed upon renewal of membership fee.
- All intending members shall be required to pay a fresh set of dues to ensure that they are properly registered and their names are duly recorded in the association’s database.
SECTION 2
RIGHTS AND DUTIES OF MEMBERS
- Each member of the association shall have right to:
- Attend all functions in the interest of the association
- Use facilities provided by the association.
- Participate in the decision making process of the association.
- Move a motion for impeachment or dissolution of a member of the executive or the entire executive council provided 2/3 of the congress agrees to it.
- Every member is entitled to a voluntary contribution by other members should cases of severe sickness, wedding, birthday e.t.c arise.
- Each member of the association shall have the following duties to undertake:
- Attend all general meetings as scheduled by the executive.
- Pay all levies as agreed by majority of the congress.
- participate in the association’s activities.
- Accept and undertake any duty as may be assigned to him by the congress or executive council.
SECTION 3
LEGAL STATUS
- CKCCOBA shall be an association guided according to the laws of the Federal Republic of Nigeria
- CKCCOBA shall be organized in accordance with the rules and regulations of our alma mater Christ The King Catholic College Odolewu Ijebu.
- CKCCOBA shall uphold the motto of our alma mater i.e Faith, Industry and Service which is against any form of discrimination whatsoever but in pursuance of our aspiration to build a united, prosperous, hitch free egalitarian society and a great nation and to equally be of good service to humanity.
ARTICLE 3 - ORGANS OF THE ASSOCIATION
SECTION 1
CONGRESS
- There shall be a general meeting called the congress, which shall comprise of all the members of the association.
- This congress shall be the highest authority of the association
- The congress shall meet every 2 TIMES YEARLY except as otherwise directed by the executive council.
- An emergency general meeting can be summoned any time, any day, the association finds it expedient as would be directed by the executive council.
SECTION 2
THE EXECUTIVE
- There shall be an executive council made up of all the members elected at the general meeting on an election day
- The executive council comprises of the following
- President
- Vice President
- Vice president 2
- General Secretary
- Assistant General Secretary
- Financial Secretary
- Assistant Financial Secretary
- Treasurer
- Social Secretary
- Public Relations Officer (P.R.O)
- Public Relations Officer(P.R.O) 2
- They shall be authorized to make bye-laws with confirmation of the general house.
SECTION 3
ADHOC COMMITTEE
- The executive council shall have power to appoint a committee to serve the association.
- The committee shall do any job dedicated to it according to the terms of preference given to it.
- The committee shall present its report to the executive council who shall either reject or accept it on behalf of the association before presentation to the congress.
ARTICLE 4 - MEETING, QUORUM, CONDUCT DURING MEETINGS AND DRESS CODE
SECTION 1
MEETING
- Emergency meetings as occasion demands shall be summoned by the association’s executive council.
- The venue of the meeting shall be as agreed by members of the executive council.
- For any binding decision to be taken, at least 2/3 of the members “MUST” be present.
- The congress shall commence its deliberations once at least ten (10) members are present.
- The council shall commence its deliberations once at least four (4) members are present.
SECTION 2
QUORUM
The quorum shall be the general house of the association but where not feasible, 2/3 of the house becomes the quorum.
SECTION 3
CONDUCT DURING MEETINGS
- Deliberations during either general meetings or executive meetings shall be conducted in accordance with the provisions of this constitution and it “SHALL” be in English Language.
- Any member wishing to contribute or deliberate must first be recognized by the Presiding Officer.
- No member shall insult or use offensive words on another member during general meetings.
- Any decision taken during any of the general meetings shall be binding on all members irrespective of the fact that any member was absent as long as Article 4, Section 2 was taken into consideration.
- No member shall create any form of pandemonium either by way of leaving the venue of the meeting while meeting is on or making or receiving a call during general meetings. They both attract a fine of N100 each.
- No member shall leave the meeting without due permission from the presiding officer.
SECTION 4
DRESS CODE
1 . Every member of the association is expected to appear in a manner of Decency.
- When necessary, the executive will suggest a particular dress code for a function.
- Violation of this code attracts a fine of N200.
ARTICLE 5 - DUTIES OF THE EXECUTIVE COUNCIL
SECTION 1
PRESIDENT
- He / She shall head and preside over all meetings of the executive and the association.
- He shall be the Chief Executive of the association.
- He shall be a signatory to the association’s account if any
- He shall have the right to appoint a congress nominated member as the electoral committee chairman.
- He shall observe strict compliance to the mission and vision of CKCCOBA
SECTION 2
VICE PRESIDENT 1
- The post of the vice president 1 shall be ceded to a person living outside the country.
- He shall see to the proper running and dissemination of information as regards the alumni to people living abroad.
- He shall observe strict compliance to the mission and vision of CKCCOBA
SECTION 3
VICE PRESIDENT 2
- He shall act in the absence of the president
- He shall chair committees and subgroups of CKCCOBA
- He shall perform his duties as directed by the president
- He shall observe strict compliance to the mission and vision of CKCCOBA.
SECTION 4
GENERAL SECRETARY
- He shall enter the proceedings of all meetings.
- He shall write and receive correspondences for the association.
- He shall record and read minute of the association’s meetings.
- He coordinates the administrative mechanism of the association.
- He shall be a signatory to the association’s account if any.
- He shall perform any other duties assigned to him by the president.
- He shall observe strict compliance to the mission and vision of CKCCOBA.
SECTION 5
ASSISTANT GENERAL SECRETARY
- He shall perform all the functions of the General Secretary where the General Secretary is indisposable or where the General Secretary so delegates.
- He shall perform any other duties assigned to him by the president.
- He shall observe strict compliance to the mission and vision of CKCCOBA
SECTION 6
FINANCIAL SECRETARY
- He shall maintain and keep financial records of the association.
- He shall give the association’s financial report to the congress during every general meeting.
- He shall perform any other duty as assigned to him by the president.
- According to Article 5, Section 4, Subsection 2, the financial report must be tendered in this order:
- Amount brought forward ( Balance as at resumption of office).
- Income per month clearly stated.
- Expenditure per month clearly stated.
- Amount carried forward ( Balanced report).
- He shall observe strict compliance to the mission and vision of CKCCOBA
SECTION 7
ASSISTANT FINANCIAL SECRETARY
- He shall perform all the functions of the Financial Secretary where the Financial Secretary is indisposable or where the Financial Secretary so delegates.
- He shall perform any other duties assigned to him by the president.
- He shall observe strict compliance to the mission and vision of CKCCOBA
SECTION 8
TREASURER
- He shall work closely with the financial secretary as regards all financial issues.
- He shall pay all monies belonging to the association into “her” account within 24 hours upon receipt of such monies expect on weekend and public holiday or any factor that might necessitate the closure of banks in which case he would be required to pay into the account within a reasonable time.
- He shall release money to the association whenever the need arises
- He shall be a signatory to the association bank account.
- He shall perform any other duty assigned to him by the president.
SECTION 8
SOCIAL SECRETARY
- He shall be in charge of all social events
- He shall perform any other duties assigned to him by the president
- He shall observe strict compliance to the mission and vision of CKCCOBA
SECTION 9
PUBLIC RELATIONS OFFICER
- He shall be responsible for information dissemination as regards meetings and programs.
- He is the image maker of the association.
- He shall be responsible for keeping an up to date register of names and phone numbers of all alumni members.
- He shall erase name of member who cease to be member of the alumni.
- He shall be responsible for yearly publication of all registered members of the alumni.
- He shall receive allocation for any program.
- He shall perform any other duties as assigned by the president.
- The PRO shall observe strict compliance to the mission and vision of CKCCOBA.
SECTION 10
PUBLIC RELATIONS OFFICER 2
- He shall perform all the functions of the PRO where the PRO is indisposable or where the PRO so delegates.
- He shall perform any other duties assigned to him by the president.
- He shall observe strict compliance to the mission and vision of CKCCOBA.
ARTICLE 6 - ALMUNI OF OTHER SET
- Every set to have passed out from CKCC are at liberty to form an alumni association for their set.
- Alumni of all others sets are to adhere strictly to the dictates of this constitution.
- Alumni of all other set shall be required to pay 25% of their monthly dues contributed by its members to the account of the overall body.
- The overall alumni body shall assist other alumni set ( when necessary) with project they intend to carry out.
- The president shall from time to time meet with other alumni president to discuss progress made and issues that may arise.
ARTICLE 7 - FINANCIAL REGULATION/ PROVISION AND BANKING
- The president, the General Secretary and the Treasurer shall be the signatories to CKCCOBA account.
- Upon handing over, none of these officers, on no account, should have access to the above named account.
- The Financial Secretary shall at every general meeting give his financial report to the congress.
- The funds of the association shall be administered solely for the purpose of furthering the objectives of the association and shall therefore be maintained in accordance with the accounting methods specified in the financial provision of the constitution cum the entire constitution.
- The association shall maintain a bank account with any bank of their choice herein referred to as CKCCOBA
- The source of funds for this account shall be the dues from every members, grants, donations and any other income as will be approved by the congress.
ARTICLE 8 - ELECTORAL MATTERS
SECTION 1
ELECTION
- There shall be election conducted on the floors of a general meeting at least five (5 weeks) before the end of the current tenure.
- This constitution grants a bye- election in case of impeachment of an incompetent officer.
- Election shall be conducted by an electoral committee nominated by the congress and handing over must be done at least three (3 weeks) before the end of the current tenure.
- The electoral committee which shall be responsible for fixing election date. Electoral committee shall comprise of four (4) members. Members shall be appointed by the congress.
- The members of the electoral committee shall include the chairman, secretary and two others.
- For election purposes, the forms for the offices to be held may be sold or given out for free as determined by members at the congress.
- After election, hand over to the newly executive must be done in totality i.e, every officer must hand over to his successor, the associations property(ies) in its general nature on that very day.
- Election procedure is to be decided by the electoral committee as approved by the president.
- Manifesto shall be presented on the day of election.
SECTION 2
ELIGIBILITY FOR ELECTION
- Any interested member must have paid his dues
- Any member interested in the post of the president and secretarial positions must have an attendance of not less than 75%
- All offices are open to all members
- An unopposed candidate shall be declared the winner of that office.
- Swearing in and taking of oath of office of eligible candidates who won the election must be done on the day of handing over.
- Any member of the electoral committee is not eligible to contest for any office.
- Nomination must be done ONCE for each office.
SECTION 3
VOTING
- Every member has the right to vote and be voted for.
- There shall be no voting by proxy.
- The chairman has a casting vote, when the scores of two candidates for a post are equal.
SECTION 4
DURATION OF OFFICE
The post of officers shall be for a period of 3 years which is renewable for another 3 years of one term if the office holder so desires.
SECTION 5
BOARD OF TRUSTEE
- Anyone who has held office for a period of two term is entitled to be a member of the board of trustee.
- Anyone who has also held office for a term is entitled to be a member of the board of trustee provided he was not impeached.
- The board of trustee is entitled to give advice and recommendation to the congress or the executive council.
SECTION 6
REMOVAL OF OFFICER
An elected officer of CKCCOBA shall be removed from office by a vote of no confidence passed against based on indiscipline, inefficiency, misconduct or fraud by a member or the congress or for any other reason considered by the association as unbecoming or inimical to the progress of the association.
SECTION 7 PROCEDURE FOR REMOVAL OF OFFICER
- A member or the congress of CKCCOBA set shall move a motion of vote of no confidence against an officer, which shall be tabled at the executive council meeting or the general meeting and such motion must be written.
- An officer on whom vote of no confidence is passed shall have the right to reply to the charge against him before a vote is taken on the motion.
SECTION 8 RESIGNATION
- An officer who resigns his portfolio shall submit his letter of resignation in writing.
- An officer shall give a minimum of two (2) months advance to CKCCOBA ,while the president shall give a three (3) months advance notice of his intention to resign.
- Every officer shall submit his letter to the president whereas the president alone shall submit his letter of resignation to the executive council in their meeting.
- It shall be the duty of the president to deliberate with the executive council on what to do to replace the vacancy when an officer’s resignation notice is received.
SECTION 9
INSURBODINATION OF A MEMBER
The executive shall have the right and power to decide the penalty terms on any matter or officer for negligence of duty, insubordination, addiction to lateness, rudeness, falsehood and fighting.
ARTICLE 9 - BYELAW, INTERPRETATION, CITATION,COMMENCEMENT AND POSSESSION OF THE CONSTITUTION
SECTION 1
BYE LAW
This constitution empowers the general body to make legislation. Any motion or resolution passed to the general house by the executive shall be positively discussed and debated upon where necessary. A vote shall be taken to settle the division of opinion after which it shall automatically become the law with 2/3 majority.
SECTION 2
INTERPRETATION, CITATION AND COMMENCEMENT
In this constitution, unless otherwise expressly provided, “He” refers to any member of the association. This bye law may be cited as the “Bye law of Christ The King Catholic College Old Boys Association (CKCCOBA)
This byelaw came into effect on the 1st day of February 2019.
SECTION 3
POSSESSION OF THE CONSTITUTION
Every member of the association MUST have a copy of the constitution.
ARTICLE 10 - AMENDMENT OF THE CONSTITUTION, VOTE OF NOCONFIDENCE, OATH OF OFFICE, SWEARING IN AND GOODWILL MESSAGE
SECTION 1
AMENDMENT OF THE CONSTITUTION
- Any amendment or addition to this statute shall be made only at general meetings.
- All motion(s) for amendment or addition to the constitution shall be carried out by at least 2/3 majority of members present at such a general meeting.
- The motion must be in unity stating the ground for the purpose of amendment.
- The executive council shall set up an amendment/ review committee, where the president appoints who to oversee the amendment.
SECTION 2
VOTE OF NO CONFIDENCE
- A vote of no confidence shall be passed when an officer is found ineffective and inefficient in carrying out his duties as an officer.
- A vote of no confidence shall be valid when passed by 2/3 majority of members present in a general meeting.
SECTION 3
OATH OF OFFICE
I ……………………………………………………….. do solemnly swear that I will be faithful and bear true allegiance to Christ The King Catholic College Old Boys Association (CKCCOBA) That as the …………………………… of the association, I will discharge my duty(ies) to the best of my ability, faithfully and in accordance with the bye-law and in the interest of the association and our alma mater, Christ The King Catholic College for a better Nigeria. So help me God.
SECTION 4
SWEARING IN
The outgoing president of the association shall swear in the new executive.
SECTION 5
GOODWILL MESSAGE
- This statute advises every member to desist from action(s) that would lead to arson, treason, felony and misdemeanor as the association shall not be an accomplice to such act.
- The officers and members should endeavour to use the constitution in all their proceeding for fair play and justice to all members.
